Anderson Strathern has an outstanding history of excellence in oral and written advocacy. Our eight Solicitor Advocates can represent clients in tribunals, the Sheriff Court, the Sheriff Appeal Court and before the Sheriff Principal, in the Court of Session and in the UK Supreme Court. In addition, as a law firm with specialists in every area, our accredited experts are recognised for the excellence of their legal opinion work.
We have grouped our Solicitor Advocates and Law Society of Scotland Accredited Specialists together in an innovative one-stop-shop for advocacy and specialist opinion services: the Advocacy and Legal Opinions Unit. Our experts can be instructed directly by clients or other firms of solicitors to provide representation in courts and tribunals across Scotland. We can also provide legal opinions on a wide range of contentious and non-contentious matters.
The Unit is headed by Robert Carr, who has been a solicitor for over 30 years, a solicitor advocate for over 20, is an accredited specialist in personal injury law and has handled cases in every tier of Scotland’s civil court system, as well as before the European Court of Human Rights in Strasbourg.
Our areas of expertise include:
Administrative and Public Law (including judicial review; statutory appeals; data protection & freedom of information; and fatal accident inquiries)
Commercial (including insolvency; contentious IP; construction; property/boundary disputes; planning and environment; and contracts disputes)
Damages Actions (including personal injury; medical negligence; defamation; production liability; motor vehicle accident claims; and professional negligence)
Insurance (including employers’ and public liability; product liability; professional indemnity; motor vehicle claims; third party claims; and nuisance)
We are also able to take urgent instructions to petition the Court for interim orders, including interdict and suspension and reduction of decisions.
How can we help?
Advocacy
Our clients are given full information on the issue of representation, including the nature, status and roles of solicitors, solicitor advocates, counsel and senior counsel. We have an excellent relationship with the Faculty of Advocates and its members, regularly instruct them, and appear with them and on the other side of them. Having given appropriate advice and received instructions from our clients, we also regularly employ our own solicitor advocates who can offer accessibility, flexibility, consistency and value.
We can take urgent instructions from clients or other firms of solicitors on any of the above areas of practice.
Legal opinions
Alongside our Solicitor Advocates, we have 24 Law Society of Scotland accredited specialists across a wide range of practice areas: medical negligence; personal injury; will and trusts; intellectual property; EU procurement; employment; rural property and family; we have specialists in commercial property and LBTT; we have experienced parliamentary drafters; mediators; those experienced in arbitrations and adjudications; and we have colleagues who are the authors of leading texts on wills, charities and agricultural law.
They are regularly instructed by other firms of solicitors or by clients directly to provide Legal Opinions on contentious and non-contentious matters; pre-litigation or mid-dispute.
